Doña Ana County sits at the southern tip of New Mexico, with its county seat in Las Cruces. It's one of the most populous counties in the state, and its court system processes a high volume of criminal, civil, family, and probate cases each year. The county falls within the Third Judicial District, which runs the district court of general jurisdiction, along with magistrate courts, a probate court, and several municipal courts. The Doña Ana County government and its elected officials — including the County Clerk and Probate Judge — also maintain certain recorded documents and vital records.
Court records in New Mexico are kept by the clerk of the court where a case was filed. For Doña Ana County district court cases, that means the Office of the Clerk at the Third Judicial District Court. You can search case information through the statewide NM Case Lookup portal, which gives free access to docket data from all district, magistrate, and metropolitan courts. If you need to view actual case documents, re:SearchNM is a subscription-based tool built on the Odyssey case management system that provides that access statewide. In-person research is also available at the courthouse in Las Cruces during business hours. NewMexicoCourts.us may also help you find publicly available court case information from across the state.

Keep in mind that this portal doesn't provide downloadable case documents.

Are Court Records Public in Doña Ana County?
Court records in Doña Ana County are generally open to public inspection. Two overlapping frameworks govern access: the New Mexico Inspection of Public Records Act (NMSA 1978, Section 14-2-1 et seq.) and the New Mexico case access policy adopted by the Supreme Court of New Mexico.
Under IPRA, every person has the right to inspect and obtain copies of public records held by government agencies, including court clerks. You don't need to explain why you're making the request. IPRA requires a response within 15 calendar days, with a possible 15-day extension if needed.
Despite that general openness, certain categories of records are off-limits to the public:
- Sealed records include documents a judge has ordered sealed in the interest of justice — such as certain domestic violence affidavits, juvenile delinquency proceedings, and adoption files.
- Confidential records cover materials protected by statute, including records involving minors, mental health commitments, and grand jury proceedings.
- Unexecuted warrants in criminal cases are not available to third parties.
- Personally identifying information — such as Social Security numbers, dates of birth, and financial account numbers — may be redacted from publicly released documents.
If you need access to sealed court records, you must file a petition with the court and demonstrate that the need for disclosure outweighs the privacy interests the seal is meant to protect. The court then weighs those competing interests before ruling on your petition.
