It is one of the most populous counties in the state, and its court system processes a high volume of criminal, civil, family, and probate cases each year. The county falls within the Third Judicial District, which operates the district court of general jurisdiction, along with magistrate courts, a probate court, and several municipal courts. The Doña Ana County government and its elected officials, including the County Clerk and Probate Judge, also serve as custodians of certain recorded documents and vital records.

Court records in New Mexico are maintained by the clerk of the court where a case was filed. For Doña Ana County district court cases, the Office of the Clerk at the Third Judicial District Court is the primary custodian. How to Look Up a Court Case in Doña Ana County?

There are three primary methods for locating a court case in Doña Ana County: online searching, visiting the clerk’s office in person, and submitting a written request by mail or electronically.

Online case search

The free NM Case Lookup tool allows anyone to search by party name or case number. To narrow results to Doña Ana County district court cases, select “District Court” as the court type and “307 – Las Cruces” as the court location after accepting the terms of use. Results display the case number, party names, case title, assigned judge, and filing date. Clicking on a case number reveals additional detail, including hearing schedules, party information, and a register of actions. This portal does not provide downloadable case documents.

For access to actual filings and images, re:SearchNM is the statewide document-retrieval system. It requires registration and charges per-search fees. re:SearchNM covers civil, criminal, family, and probate case documents from all New Mexico district courts.

Written and electronic requests

Under the New Mexico Inspection of Public Records Act (IPRA), anyone may request copies of public court records. Electronic requests can be submitted through the IPRA web form, which routes the request to the Third Judicial District Court’s Records Custodian. Alternatively, mail a written request to:

Acceptable payment methods include cash, money order, cashier’s check, and credit or debit card (2.4% surcharge applies). Personal checks are not accepted. All monetary transactions must be completed by 4:00 p.m. (3:00 p.m. on the last day of each month).

Are Court Records Public in Doña Ana County?

Court records in Doña Ana County are presumptively open to public inspection. Two overlapping legal frameworks govern access: the New Mexico Inspection of Public Records Act (NMSA 1978, Section 14-2-1 et seq.) and the New Mexico case access policy adopted by the Supreme Court of New Mexico.

Under IPRA, every person has the right to inspect and obtain copies of public records held by government agencies, including court clerks. There is no requirement to state a reason for the request. IPRA requires a response within 15 calendar days, with a possible 15-day extension.

Despite the presumption of openness, certain categories of records are shielded from public access:

  • Sealed records include documents that a judge has ordered sealed in the interest of justice, such as certain domestic violence affidavits, juvenile delinquency proceedings, and adoption files.
  • Confidential records encompass materials protected by statute, including records involving minors, mental health commitments, and grand jury proceedings.
  • Unexecuted warrants in criminal cases are not available to third parties.
  • Personally identifying information, such as Social Security numbers, dates of birth, and financial account numbers, may be redacted from publicly released documents.

A person who needs access to sealed court records must file a petition with the court and demonstrate that the need for disclosure outweighs the privacy interests protected by the seal. The court then weighs the competing interests before ruling on the petition.

Doña Ana County Criminal Court Records

Criminal cases in Doña Ana County are heard primarily in the Third Judicial District Court (felonies and some misdemeanors) and the Doña Ana County Magistrate Courts (misdemeanors, DWI, traffic offenses, and preliminary felony hearings). Municipal courts in Las Cruces, Anthony, Hatch, Mesilla, and Sunland Park handle city ordinance violations and certain traffic matters.

Statewide criminal history records are maintained by the New Mexico Department of Public Safety, Law Enforcement Records Bureau. Arrest and inmate information

The Doña Ana County Sheriff’s Office maintains arrest records and booking data. Doña Ana County Civil Court Records

The Third Judicial District Court has exclusive original jurisdiction over civil cases involving torts, contracts, real property rights, and claims above $10,000. Magistrate courts handle civil disputes of $10,000 or less, as well as landlord-tenant matters. Small claims proceedings fall under magistrate court jurisdiction.

Filing fees are non-refundable per Local Rule 13-601 of the Third Judicial District. Fees must be paid when the action is filed and will not be returned for any reason, including dismissal. No fees are charged against state, city, county, or nonprofit educational corporations, or U.S. government agencies.

Property records

Real estate documents such as deeds, mortgages, plats, and liens are recorded by the Doña Ana County Clerk’s Office rather than the court. Doña Ana County Family Court Records

Family law cases in Doña Ana County are adjudicated by the Third Judicial District Court, which has exclusive jurisdiction over domestic relations matters. These include dissolution of marriage (divorce), child custody and timesharing, child support, spousal support, domestic violence protection orders, adoption, and paternity proceedings.

Filing fees

A domestic relations case filed in the Third Judicial District Court requires a $137.00 docket fee (per NMSA 1978, 34-6-40 and 40-12-6). This fee applies to divorce, custody, and other family law petitions. The Self Help Center at the courthouse provides free assistance for self-represented litigants navigating the filing process.

Searching family court records

Family case information appears in the NM Case Lookup portal alongside other case types. However, access to specific documents may be restricted when a case involves minors or protective orders. Domestic violence affidavits, juvenile records, and adoption files are typically sealed from public view.

Marriage licenses and certificates

The Doña Ana County Clerk issues marriage licenses by appointment. Both applicants must appear in person with a completed application and government-issued photo ID. The license fee is $55.00 (cash, check, credit card, or money order). Licenses are valid statewide and must be returned to the Clerk’s Office within 90 days of the ceremony. An online marriage application can be submitted in advance, or applicants may bring a printable application form.

Certified copies of recorded marriage licenses cost $2.50 each and can be requested through the Clerk’s document request form.

Birth and death records

Birth and death certificates for events that occurred in Doña Ana County can be obtained from the Doña Ana County Health Center or the New Mexico Department of Health, Vital Records. Each certified copy costs $10.00. Access is restricted to the record subject, immediate family members, or authorized representatives for records less than 100 years old. Requesters must present a valid government-issued photo ID.

Doña Ana County Probate Court Records

Doña Ana County maintains a dedicated Probate Court with limited jurisdiction over informal probate proceedings and uncontested estates. More complex or contested probate matters, including formal estate administration and will contests, are handled by the Third Judicial District Court.

When a case is opened at the Probate Court, six certified copies of the Letters of Administration or Letters Testamentary are included with the endorsed docket. Application packets can be purchased at the Probate Court for $5.00, and downloadable probate forms are available on the county website. All pro se forms from the Probate Court may also be used at the Third Judicial District Court by changing the header to reference the district court.
