Are Court Records Public in Eddy County?

Eddy County Civil Court Records

Civil jurisdiction in Eddy County is shared among the District Court and the Magistrate Courts. The Fifth Judicial District Court handles civil cases with higher amounts in controversy and complex litigation including property disputes, personal injury claims, breach of contract, and equity matters. The Magistrate Courts handle civil claims of $10,000 or less, dispossessory (eviction) proceedings, and garnishments.

Divorce Records

Divorce decrees and related filings are maintained by the District Court Clerk and also preserved by the Eddy County Clerk. Birth and Death Records

Under New Mexico law, birth and death records are restricted-access records. Birth certificates become public 100 years after the date of birth, and death certificates become public 50 years after the date of death. Eddy County Probate Court Records

The Probate Judge holds limited office hours, as the position is part-time by law:

Note that certain probate-related matters — including adoption, guardianship, and dependency cases — are confidential and subject to strict dissemination restrictions.
