The judicial system here operates within the Fifth Judicial District and includes a District Court, a Probate Court, multiple Magistrate Courts, and several Municipal Courts. Searching online. The New Mexico Judiciary Case Lookup portal gives you free access to case information from District Courts, Magistrate Courts, and Municipal Courts statewide. Requesting copies. Copies of District Court records cost $0.35 per page, with certified copies requiring an additional $1.50 per seal. Lea County Clerk records — including marriage, probate, and property documents — cost $0.50 per page. You can submit requests in person, by mail, or by email to the District Court at lovdfax-grp@nmcourts.gov. Include the case number or party names, a description of the documents needed, and payment for estimated fees.
Are Court Records Public in Lea County?
New Mexico law gives the public broad access to court records through two main legal frameworks.
N.M. Rule of Civil Procedure 1-079. Rule 1-079 NMRA establishes that court records are open to the public unless they've been sealed by court order or are otherwise protected from disclosure. The rule applies to all records filed with or generated by the District Court and sets out both the inspection and copying procedures.
New Mexico Inspection of Public Records Act (IPRA). The IPRA requires government entities — including courts — to make records available for inspection unless a specific statutory exemption applies. The Lea County Clerk's website confirms that by state law, all records in the clerk's office are permanent and available to the public.
Records excluded from public disclosure under Rule 1-079.1 include:
- Adoption proceedings
- Mental health proceedings
- Wills deposited with the court (prior to probate)
- Attorney-client privileged information
- Proceedings to detain a person under NMSA 24-1-15
- Proceedings for testing under NMSA 24-2B-5.1

Lea County Criminal Court Records
Criminal prosecutions in Lea County move through different courts depending on the severity of the offense.
District Court (felonies and serious matters). The Lea County District Court, part of the Fifth Judicial District, has jurisdiction over felony cases, appeals from lower courts, and other criminal matters assigned by statute. Statewide criminal history checks. The New Mexico Department of Public Safety Law Enforcement Records Bureau maintains the state criminal history repository. To get an individual's arrest record, submit a notarized Authorization for Release of Information form along with a $15.00 fee (money order or cashier's check payable to the Department of Public Safety). A Police Certificate of Good Standing — typically used for immigration purposes — has a combined fee of $33.00. Processing takes 7 to 15 working days. Mail requests to:

Lea County Civil Court Records
Civil litigation in Lea County moves through the District Court for cases with broader jurisdiction and through the Magistrate Courts for smaller claims.
District Court. The Lea County District Court hears civil matters covering contract disputes, property damage, personal injury, condemnation, foreclosure, debt collection, water adjudications, appeals from Magistrate and Municipal Courts, and any civil case not exclusively assigned to another court. Magistrate Courts. The Magistrate Courts hear civil claims within their jurisdictional limit, including small claims and landlord-tenant disputes. Contact the specific Magistrate Court where the case was filed for record requests.

Property records in the clerk's office go back to 1917, with grantee and grantor index books from 1917 to 1981 scanned and available online under the Scanned Indexing tab on the Liveweb portal. Lea County Family Court Records
The District Court handles most family law matters in Lea County — divorce, child custody, child support, paternity, adoption, domestic violence protective orders, and guardianship proceedings. The Probate Court has concurrent jurisdiction over certain uncontested guardianship and conservatorship matters.
Divorce records. Divorce decrees, property division orders, and parenting plans are part of the District Court case file and are kept by the clerk's office. Copy fees are $0.35 per page; certification costs $1.50 per seal.
Adoption records. Adoption proceedings are confidential under Rule 1-079.1 and are not available for public inspection.
Marriage licenses. The Lea County Clerk issues marriage licenses at the Lovington office. Key details:
- License fee: $55.00 (cash only — no checks or credit cards)
- No blood test required; no waiting period
- Both applicants must present a valid driver's license or student ID with birth date
- Applicants must be 18 or older (16–17 with parental consent; under 16 with a District Court order)
- The license does not expire and is valid when the ceremony is performed anywhere in New Mexico
- The license must be returned to the County Clerk within 90 days of the ceremony
Marriage records can be searched online through the Clerk Marriage Lookup tool by date, groom's name, or bride's name. In-person requests cost $0.50 per page.
Birth and death records. Lea County vital records are restricted. Birth certificates are confidential for 100 years after the date of birth, and death certificates are restricted for 50 years after the date of death. During those restricted periods, only the registrant, immediate family members (spouse, parent, sibling, child, grandchild, or grandparent), or individuals with a demonstrated legal interest may obtain copies.
Vital records can be requested through the New Mexico Bureau of Vital Records and Health Statistics by mail or in person. Mail requests require a completed application — birth record form or death record form — along with a photocopy of a government-issued photo ID and the applicable fee:

Lea County Probate Court Records
The Lea County Probate Court has limited jurisdiction under New Mexico law. It handles informal (uncontested) probate proceedings — admitting wills to informal probate, appointing personal representatives without a hearing, and overseeing the orderly transfer of a decedent's property. Contested matters, such as disputes over will validity or heirship, are referred to the District Court, which has concurrent probate jurisdiction.
The Lea County Clerk serves as the Probate Clerk and maintains all probate proceedings executed by the Probate Judge.
