The District Court exercises general jurisdiction over felonies, civil cases, domestic relations, and appeals from the magistrate and municipal courts. The Magistrate Court handles misdemeanors, traffic violations, and civil claims within its statutory limits. The Municipal Court addresses ordinance violations and certain misdemeanors occurring within city limits. The Probate Court adjudicates informal probate matters.

- Submit a written request. The Twelfth Judicial District Court provides a fillable Records Request Form that can be mailed or delivered to the court. The form requires the plaintiff and defendant names, case number, case type, and filing date. You can check a box to request the entire case file.
- Visit the courthouse in person. Court dockets and case files can be inspected at the appropriate clerk's office during business hours. Requests to the District Court can also be submitted through the IPRA online request form maintained by the New Mexico Administrative Office of the Courts.

Are Court Records Public in Otero County?
Court records in Otero County are generally open to the public under New Mexico's Inspection of Public Records Act (IPRA), codified at NMSA 1978, 14-2-1 through 14-2-12. The Act requires public officers and employees to respond to inspection requests as a routine part of their duties. New Mexico Court Rule 1-079 NMRA further defines a court record as any document, paper, exhibit, transcript, or other material filed or lodged with a court, as well as registers of actions and docket entries.
When a records custodian receives an inspection request, they must permit inspection immediately or as soon as practicable — but no later than 15 calendar days after receipt. If records can't be made available within three business days, the custodian must provide a written explanation of when they will be ready or when the public body will respond.
Certain court records are restricted from public access or require redaction before release:
- Protected personal identifiers must be redacted, including the last four digits of Social Security numbers, taxpayer identification numbers, financial account numbers, and driver's license numbers.
- Wills deposited with the probate court before probate proceedings are opened are restricted.
- Records from mental health proceedings are confidential.
- Adult Protective Services court records are not publicly available.
- Juvenile court records are restricted under N.M. Stat. 32A-2-32.
- Records that have been sealed or expunged by court order remain inaccessible.

Otero County Criminal Court Records

Criminal records from either agency can be requested using the Alamogordo Police Department's public records request form (PDF). Include the name of the individual who is the subject of the search along with a return address for delivery. Keep in mind that each agency provides criminal information only for arrests and incidents within its own jurisdiction.
For statewide criminal background checks, the New Mexico Department of Public Safety operates the Law Enforcement Records Bureau. Background search requests can be submitted through that bureau, and copies of criminal history reports from across the state are forwarded to qualified requesters.
Otero County Civil Court Records
Civil disputes in Otero County are divided between the District Court and the Magistrate Court based on the amount in controversy and case type. The Otero County Clerk's Office maintains a separate online document database for recorded civil instruments, including deeds, mortgages, liens, UCC financing statements, and plats. You'll need to create an account to search the database. Recording fees charged by the County Clerk are:

Payments are accepted by cash, check, money order, cashier's check, and all major credit cards, made payable to the Otero County Clerk's Office. Documents submitted for recording must be originals, properly notarized with a correct acknowledgment, and must include a legal description or a book-and-page reference. If the document is to be returned by mail, include a self-addressed stamped envelope.

Otero County Family Court Records
Domestic relations cases in Otero County — including divorce, child custody, child support, adoption, and orders of protection — are handled by the Twelfth Judicial District Court's domestic division. The filing fee for domestic cases in the District Court is $137.00. The court's Records Request Form can be used to request copies of divorce decrees and other family case documents by mail. Provide the names of both parties, the case number, the case type, and the filing date. Certified copies of divorce records cost $0.35 per page plus a $1.50 certification fee per document.
Divorce records in Otero County are treated as confidential and are available only to the parties involved in the proceedings or their authorized attorneys. General case docket information — such as filing dates and hearing schedules — may still be accessible through the Case Lookup portal, but access to the underlying documents is restricted.
Marriage Licenses. The Otero County Clerk's Office issues marriage licenses. Both applicants must appear together, and the following requirements apply:
- Applicants aged 18 or older must present a picture ID or a state-certified birth certificate.
- Applicants aged 16 or 17 require consent from all parents listed on their birth certificate, along with proof of age. A court order may also be accepted.
- Applicants under 16 may not apply except with a court order.
- The fee is $55.00 in cash, payable at the time of application (effective June 20, 2025, per Senate Bill 290). No other forms of payment are accepted for this fee.
- The license is valid indefinitely but must be returned to the Clerk's Office within 90 days after the ceremony for recording.
- The marriage must be performed within the State of New Mexico by a minister or civil celebrant authorized by a Virginia Circuit Court within the Commonwealth. Retired judges, justices, and magistrates are also authorized.

Birth and Death Records. These vital records have restricted access under New Mexico law. Only immediate family members or individuals who can demonstrate a legal interest may obtain certified copies. Records can be requested from the local Otero County Public Health Office at 1207 8th Street, Alamogordo (Phone: (575) 437-9340), or from the New Mexico Department of Health's Bureau of Vital Records and Health Statistics. The state office accepts requests by phone at (505) 827-0121 or by mail using the official application forms for birth certificates and death certificates. A certified birth certificate costs $10.00 per copy, and a certified death certificate costs $5.00 per copy.
Otero County Probate Court Records
The Otero County Probate Court handles informal probate proceedings, including the administration of estates with and without wills, appointment of personal representatives, and issuance of proof of authority. The court is presided over by the elected Probate Judge, currently Jessica Suggs.

The docket fee to file for informal probate is $30.00 and is non-refundable. The court provides downloadable form packets on the Otero County Probate Judge page:

If the decedent left no will, the estate is distributed according to New Mexico's intestate succession statutes. Probate always takes place in the jurisdiction where the decedent last resided and covers only assets held solely in the decedent's name.
